⚠ MANDATORY U.S. REGULATORY DISCLOSURE: CFTC RULE 4.41
HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT ACTUALLY BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.
1. Extreme Risk of Leveraged Financial Derivatives
Trading foreign exchange (Forex), contracts for difference (CFDs), cryptocurrency futures, equities, and commodities involves an exceptionally high level of financial risk and may not be suitable for all individuals.
The high degree of financial leverage available in retail and institutional trading accounts can work against you as well as for you. The use of leverage can lead to the rapid and complete loss of your invested capital. In certain margin-trading circumstances, losses may exceed your initial deposited balance. You should never risk or invest money that you cannot afford to lose completely without endangering your financial security or living standards.
2. No Representation of Future Profitability
Past performance of any trading methodology, algorithm, cTrader cBot, backtest, manual setup, or quantitative model does not guarantee, predict, or imply future performance or success.
- Financial markets are subject to macroeconomic regime shifts, sudden liquidity flash crashes, geopolitical volatility, and black-swan events.
- A trading strategy that demonstrated high historical expectancy or profitability during a specific backtest period may fail completely during changing market conditions.
- Jastun makes zero promises, warranties, or guarantees that utilizing our tools (including Anyted, Proppass, or Simark) will generate trading profits or shield accounts from financial loss.
3. Proprietary Trading Firm Evaluation Challenge Risks
Trading with proprietary trading firms (prop firms) involves distinct contractual and financial hazards that all participants must understand:
- High Statistical Failure Rates: Empirical industry data confirms that a substantial majority (often exceeding 90%) of evaluation challenge participants fail to reach funded status or breach drawdown rules prior to receiving their first payout.
- Evaluation Fee Loss: All fees paid to prop firms for challenges, resets, or account registrations are fully at risk. If you breach a daily or maximum drawdown rule, your account is immediately terminated by the prop firm without fee refund.
- Drawdown Mechanics: Many prop firms enforce trailing drawdown calculations based on peak unrealized floating equity rather than closed balance. A trade that is profitable intra-day can pull back, trigger a trailing drawdown breach, and result in immediate disqualification.
- Software Limitations: While Proppass is designed to act as an automated drawdown guardian, no software can override severe broker slippage, liquidity gaps over weekends, or broker disconnects during high-impact news releases (e.g., FOMC, NFP, CPI). You remain entirely responsible for monitoring account risk parameters.
4. Technological, Execution & Internet Latency Risks
Systematic and algorithmic trading relies heavily on complex technological infrastructure:
- Slippage & Spread Widening: Market orders are subject to liquidity slippage. During volatile periods, the price at which your stop-loss or profit target executes may differ substantially from the requested price.
- Communication & Hardware Failure: Jastun bears no responsibility for trading losses caused by client hardware failure, operating system crashes, local internet disconnection, broker server latency, or Spotware cTrader Open API maintenance windows.
- Execution Delays: Orders transmitted to a broker travel across digital networks. Transmission latency may cause orders to fill at prices different from real-time chart displays.
