Please read these Terms of Service (“Terms,” “Agreement”) carefully before accessing or utilizing the website (jastun.com), educational materials, software tools, applications, or APIs provided by Jastun (“we,” “us,” or “our”), including Anyted, Proppass, and Simark.

By accessing our website, creating an account, or downloading/running our software, you acknowledge that you have read, understood, and agreed to be bound by these legally enforceable Terms. If you do not accept these Terms in their entirety, you must discontinue access immediately.

2. Eligibility & Account Security

• Age Requirement: You must be at least 18 years of age or the age of legal majority in your jurisdiction to utilize Jastun software and services.
• Account Integrity: You agree to provide accurate, current, and complete registration information. You are solely responsible for maintaining the confidentiality of your account credentials, license keys, and API tokens.
• Single User License: Platform licenses and software keys are non-transferable and intended solely for your personal or authorized corporate use. Sharing, distributing, or multi-tenanting single-user credentials without express written authorization is strictly prohibited.

3. Proprietary Intellectual Property Rights

All content, source code, mathematical algorithms, user interface designs, logos, software binaries, trade dress, documentation, and research articles published by Jastun are the exclusive intellectual property of Jastun and are protected by international copyright, trademark, and trade secret laws.

• You are granted a limited, revocable, non-exclusive, non-transferable license to access our platform and run our software binaries in accordance with your subscription tier.
• You expressly agree NOT to decompile, reverse-engineer, disassemble, modify, create derivative works of, or attempt to extract the source code or proprietary algorithms of Anyted, Proppass, or Simark.

4. Acceptable Use Policy & Prohibited Conduct

When accessing Jastun infrastructure or utilizing our software, you agree that you will not:

• Deploy automated scrapers, bots, or extraction scripts against our website or APIs without prior written permission.
• Engage in denial-of-service (DDoS) attacks, exploit vulnerability probes, or disrupt the normal operation of our servers.
• Misrepresent your identity or claim formal affiliation with, endorsement by, or employment at Jastun.
• Circumvent licensing checks, modify binary code, or distribute cracked/modified versions of Jastun software.

5. Third-Party Platforms, Prop Firms & Broker Connectivity

Jastun software connects with third-party trading terminals, brokers, and proprietary trading firms (including Spotware cTrader, MetaQuotes, FTMO, etc.):

• Independent Operation: Third-party brokers and prop firms operate independently of Jastun. We do not control broker server stability, execution latency, spread widening, or slippage.
• Rule Variations: Proprietary trading firms frequently amend their challenge evaluation rules, maximum drawdown algorithms, and news holding policies. While Proppass is engineered to monitor standard parameters, it remains the trader’s sole responsibility to ensure full compliance with their individual firm’s contractual rules.
• Zero Broker Liability: Jastun bears no liability for broker server outages, internet disconnection, liquidity pool illiquidity, or terminal crashes.

6. Subscriptions, Payments & Cancellation Policy

• Billing: Software licenses and subscription access are billed in advance on a recurring monthly or annual basis, or as a single lifetime payment where explicitly offered.
• Cancellation: You may cancel recurring subscriptions at any time via your account portal. Upon cancellation, access continues until the end of your paid billing period, after which it terminates without further billing.
• Refund Policy: Due to the digital and instantly consumable nature of software binaries and algorithmic tools, refund requests are evaluated strictly according to our published Refund Terms. Technical failure to configure software does not constitute valid grounds for refund if support has been offered.

7. Disclaimer of Warranties (“As-Is” Provision)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, PLATFORMS, APIS, RESEARCH ARTICLES, AND SOFTWARE TOOLS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

JASTUN EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM PROGRAM ERRORS, SYSTEM UPTIME, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SOFTWARE FUNCTIONS WILL OPERATE UNINTERRUPTED OR ERROR-FREE, OR THAT TRADING ALGORITHMS WILL GENERATE PROFITS OR PREVENT TRADING LOSSES.

8. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL JASTUN, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• ANY FINANCIAL LOSSES, TRADING LOSSES, CAPITAL DEPLETION, OR BREACHED PROP FIRM EVALUATION FEES;
• LOSS OF DATA, USE, GOODWILL, OR BUSINESS REPUTATION;
• DAMAGES RESULTING FROM SOFTWARE DEFECTS, EXECUTION DELAYS, HARDWARE LATENCY, OR BROKER CONNECTION INTERRUPTIONS.

IN NO EVENT SHALL JASTUN’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO JASTUN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).

9. Indemnification

You agree to defend, indemnify, and hold harmless Jastun and its subsidiaries, affiliates, officers, and employees from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of our software, or your trading activities in the financial markets.

10. Governing Law, Severability & Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of international commercial arbitration, without regard to conflict of law principles.
• Arbitration: Any dispute, controversy, or claim arising out of this Agreement shall be settled by confidential binding arbitration before a single arbitrator under international arbitration rules.
• Severability: If any provision of these Terms is deemed unlawful or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

11. Amendments and Contact Details

We reserve the right to revise these Terms at our sole discretion. Your continued use of the platform following the posting of revised Terms constitutes explicit acceptance.
